Beagle Software ehf. (“PostBeagle”) operates a zero-tolerance policy toward spam. Our reputation - and that of every customer who sends through us - depends on responsible sending. This Anti-Spam Policy is part of our Terms of Service and applies to everyone who uses the Service. Violations may result in immediate suspension or termination.
1. What we mean by spam
“Spam” is any unsolicited commercial or bulk email - that is, email sent to recipients who have not given you valid, verifiable permission to contact them. Permission is the foundation of every campaign you send through PostBeagle.
2. Permission is required
You may only send email to recipients who have given you express, opt-in consent to receive it. You must be able to demonstrate, for each recipient, when and how that permission was obtained. You may not send to:
- purchased, rented, leased or otherwise third-party lists;
- email addresses scraped or harvested from websites, directories or social media;
- addresses you have not collected yourself with clear consent;
- recipients who have unsubscribed, complained or otherwise opted out.
3. Every campaign must include
- A clear, working unsubscribe link in every message, and you must honour opt-out requests promptly (and automatically through the Service).
- An accurate sender identity - truthful “From”, “To” and “Reply-To” fields and a subject line that is not deceptive or misleading.
- Your valid physical postal address, as required by anti-spam laws such as CAN-SPAM.
- Content that matches the consent given - don’t send materially different content from what the recipient signed up for.
4. Prohibited content and practices
You may not use the Service to send or promote:
- phishing, malware, or fraudulent or deceptive material;
- content that is unlawful, defamatory, harassing, hateful or infringing;
- highly regulated or commonly abused categories where prohibited by us or by law (for example certain pharmaceuticals, illegal substances, or get-rich-quick schemes);
- messages with falsified headers, disguised origins, or open relays/proxies.
5. Compliance with law
You are responsible for complying with all applicable laws governing electronic communications, including the EU GDPR and ePrivacy rules, the U.S. CAN-SPAM Act, and Canada’s Anti-Spam Legislation (CASL). Where these laws are stricter than this Policy, the stricter standard applies.
6. Monitoring and enforcement
We continuously monitor sending activity, including bounce rates, spam-complaint rates and recipient engagement. To protect deliverability for all customers, we may:
- throttle, pause or block campaigns that show abnormal bounce or complaint rates;
- require you to verify your permission practices or clean your lists;
- suspend or terminate accounts that violate this Policy, without refund.
7. Reporting abuse
If you have received email sent through PostBeagle that you believe is spam, or you wish to report a violation of this Policy, please contact us at [email protected]. We investigate all reports and take appropriate action.
8. Consequences of violations
Violations of this Policy may result in warnings, throttling, suspension or immediate termination of your account, and may be reported to relevant authorities where required. We reserve the right to take any action we deem necessary to protect the Service and its users.
